In December 2016, the federal government passed the 21st Century Cures Act. This law established requirements for states to implement electronic visit verification for Medicaid-funded Personal Care Services and Home Health Care Services. The original implementation date for PCS was January 1, 2021, however, Ohio was granted a Good Faith Effort Exemption which allowed them until January 1, 2021, to implement EVV. If providers are not compliant by that date, FMAP (Federal Medical Assistance Percentage) reductions will take place. HHCS providers have until January 1, 2023, to implement EVV.

Electronic Visit Verification Requirements
According to the Ohio Department of Medicaid (ODM), agency providers have the option of choosing their own EVV system as long as it can electronically capture all of the required information at the time of service, including:
- Date of service
- Individual receiving the service
- Name of individual providing the service
- Location of service
- Type of service performed
- Time the service begins and ends

Status of EVV Implementation in Ohio
Ohio’s Department of Medicaid established a three-phase system for implementing EVV within the state. Phase 1 began in 2018 and included those who provided services that were directly billed to Medicaid. Phase 2 was implemented in May 2019 and required Managed Care Organizations that bill Medicaid to comply with EVV requirements. Phase 3 began in September of 2020 and included self-directed and other remaining services not already covered under phases 1 and 2.
