By now, most healthcare organizations that provide Home and Community-Based Services are aware of the federal mandate that requires electronic visit verification for home visits and services received by Medicaid recipients. This mandate is based on Section 12006(a) of the 21st Century Cures Act that was signed into law in December of 2016. According to this mandate, states are required to implement a system for EVV for all Medicaid-funded personal care services (PCS) and home health services (HHCS) that require an in-home visit by a provider.

HCBS providers will need to be in compliance with the mandate by a designated implementation date, depending on the type of services rendered. For in-home personal care services, the implementation date was January 1, 2021 — however, nearly all states have requested a good faith effort exemption request allowing them more time to comply if the exemption was approved. 

For those businesses that provide home healthcare services, they have until January 1, 2023, to comply. And, although that date may seem like a long way off, implementing EVV isn’t as simple as flipping a switch. Where Does Your HCBS Organization Stand?

Most states filed a good-faith exemption request near the end of last year allowing them to have more time to implement EVV without penalty. You can review the approval letters for each state by visiting the electronic visit verification section of the Medicaid website. Most states have been granted an extension of one year — meaning that they won’t be subject to penalties until January of 2021.
